Where can you legally consume cannabis in San Diego?
Two places: a private residence where the owner permits it, and a licensed consumption lounge. San Diego County has one, Sessions by the Bay in National City. Everywhere else is prohibited — public consumption carries a fine of up to 250 dollars, and beaches, parks, sidewalks and vehicles are all public for this purpose.
Buying cannabis in San Diego is straightforward. Finding a lawful place to consume it is not, and that gap catches out a very large number of visitors. The retail experience feels permissive, so people reasonably assume consumption is treated the same way. It is not.
Where consumption is prohibited
- Any public place — sidewalks, plazas, transit stops, and public buildings.
- Beaches and parks — prohibited as public places under state law, and separately prohibited by San Diego smoking rules at city beaches and parks.
- Vehicles — consumption is prohibited whether the vehicle is moving or parked. Cannabis must be transported in a sealed container or in the trunk.
- Anywhere tobacco smoking is prohibited — the same restrictions apply to smoking cannabis.
- Near schools, day care, and youth centers — treated more seriously while children are present.
- Federal property — including military installations and national parks, where cannabis remains prohibited outright.
The beach is the most common mistake
Pacific Beach, Ocean Beach, Mission Beach, and Coronado are exactly where visitors expect this to be tolerated, and they are among the most visibly patrolled places in the city. The rule is not ambiguous and it is enforced.
Where consumption is permitted
A private residence, where the person who controls the property allows it — your own home, or someone else home with their agreement. And a licensed consumption lounge, of which San Diego County currently has exactly one. Everything past those two depends on someone else policy rather than on state law.
Hotels and short-term rentals
A hotel is private property and sets its own rules. Most San Diego hotels prohibit smoking of any kind indoors, and many prohibit cannabis specifically, including on balconies and patios. Short-term rental platforms typically let hosts set their own policy, and many hosts prohibit it. Assume prohibition unless the property states otherwise in writing.
Licensed consumption lounges
California allows local jurisdictions to authorise on-site consumption, and most have not. National City approved consumption lounges in May 2022, the first municipality in San Diego County to do so, and Sessions by the Bay opened there in April 2025 as the county first licensed cannabis lounge. It is a state-licensed, locally permitted retail business with a dispensary downstairs and a lounge and restaurant above, open to adults 21 and over.
If you are staying somewhere that prohibits consumption, this is the practical answer. Do not assume any other venue permits on-site consumption simply because it sells cannabis — authorisation is specific, and a retailer without it cannot let you consume on the premises. Check current status before you travel to a venue; this is a fast-moving area and more lounges may open.
Driving
Driving under the influence of cannabis is a DUI in California, prosecuted like any other impaired-driving offense. There is no permitted amount. Separately, an open container of cannabis in a vehicle is prohibited — anything you are carrying must be sealed or in the trunk, including on the drive back from the dispensary.

- Can you smoke cannabis on the beach in San Diego?
- No. Public consumption is prohibited under state law, and San Diego separately prohibits smoking at city beaches and parks. This is one of the most commonly and most visibly enforced rules in the city.
- Can you consume cannabis in a hotel room in San Diego?
- Only if that specific property permits it, and most do not. A hotel is private property and sets its own policy. Smoking in a non-smoking room typically triggers a cleaning fee and can end the stay.
- Can you consume cannabis in a parked car?
- No. Consuming cannabis in a vehicle is prohibited whether or not it is moving, and cannabis must be transported in a sealed container or in the trunk.
- Are there cannabis lounges in San Diego?
- One. Sessions by the Bay in National City opened in April 2025 as the first licensed cannabis consumption lounge in San Diego County. Consumption lounges need specific local authorisation and most jurisdictions in the county have not granted it, so do not assume any other venue permits on-site consumption.
- Is driving after using cannabis a DUI in California?
