San Diego cannabis law
Can you bring weed through a Border Patrol checkpoint?
No. Possessing marijuana without a valid prescription is still a federal offense, and the permanent Border Patrol checkpoints on Interstate 5, Interstate 15 and Interstate 8 enforce federal law. So does federal land in San Diego County, including Cabrillo National Monument and the Cleveland National Forest. California’s legalization stops at all of them.
The checkpoints around San Diego
Border Patrol runs three permanent traffic checkpoints on the main roads out of the county. Each is federal ground, and a California receipt is no defense there.
- Northbound Interstate 5 near San Clemente.
- Interstate 15 near Temecula.
- Westbound Interstate 8 near Pine Valley.
Federal land in San Diego County
- Cabrillo National Monument, a national park unit on Point Loma.
- The Cleveland National Forest, in the mountains east of the city.
- National wildlife refuges.
- Military installations, where cannabis is prohibited outright.
What the 2026 federal rule changed
In April 2026 the Drug Enforcement Administration moved state-licensed medical marijuana to Schedule III. All other marijuana stayed in Schedule I, and possessing it without a valid prescription is still a federal offense. Nothing in the rule makes adult-use cannabis lawful on federal land.
Common questions
Will Border Patrol take my legal weed at the I-5 checkpoint?
You have no protection there. Agents at the checkpoint enforce federal law, under which possessing marijuana without a valid prescription is an offense, whatever a California receipt says.
Can I bring cannabis to Cabrillo National Monument?
No. Cabrillo is a national park unit, and cannabis is prohibited on federal land in California.
Is weed legal in the Cleveland National Forest?
No. National forests are federal land, where cannabis is prohibited even though California allows it elsewhere.
Did the 2026 federal rescheduling make weed legal on federal land?
No. The April 2026 rule moved state-licensed medical marijuana to Schedule III and left all other marijuana in Schedule I. Possession without a valid prescription remains a federal offense.
Do I pass a checkpoint driving north from San Diego?
Yes, on northbound Interstate 5 near San Clemente and on Interstate 15 near Temecula. Westbound Interstate 8 near Pine Valley has one too.
